Section 140
<br> to be informed if the person required to appear on the date is incarcerated
If the person who is supposed to appear in the court on the specified date is unable to appear due to detention, he or his family member, legal practitioner, or heir should inform the court about the issue in which he is detained.
(2) According to sub-section (1), upon receiving information that a person has been detained, the court shall demand information from the relevant agency as to why he was detained and for how long he is to be detained.
(3) Upon request for information according to sub-section (2), the relevant agency shall immediately inform the court where the case is filed, if the detained person is unable to be released from open detention immediately, including the probable days of detention.
(4) If a person detained under sub-section (3) is informed that he will be released within one month, and if he comes to appear on the date within seven days from the date of his release, except for the date of leave, the same day shall be considered as the day of appearance and the case of setting a date shall be dealt with according to the law.
(5) If the person who has been imprisoned according to sub-section (3) is informed that he will be imprisoned for more than one month, the date of his release from imprisonment has not been fixed or he cannot be released from imprisonment immediately, the court shall not wait for him to process, hear and dispose of such case.
(6) If a person who is incarcerated sends an heir to do the work that he is supposed to do during that period, the appointed heir can do such work on his behalf.
(7) In spite of anything written in sub-section (5), if the case is not disposed of without any side of the case or without understanding it, the court shall proceed, hear and dispose of the case after disposing of it according to the law.
(8) Notwithstanding anything written elsewhere in this section, if a person who is in custody during the proceedings of the case comes to appear in court within seven days except for the period of leave from prison, the case shall be processed, heard and disposed of.
